All content on our website — including text, layout, design, and written materials — is the intellectual property of Bakti Guaman. You may not reproduce, distribute, or republish any content from our website without prior written consent.

Documents prepared by Bakti Guaman in the course of your engagement remain our intellectual property until all fees relating to that matter have been paid. Copies provided to you are for your personal use only.

6. Fees and Payment

All fees are stated in Malaysian Ringgit (RM) and are confirmed in writing prior to commencement of any work. Payment terms are set out in the engagement letter for each matter.

We accept payment by bank transfer, cheque, or such other methods as may be agreed. Payment is due upon receipt of our invoice unless otherwise agreed in writing.

Where additional work is required beyond the agreed scope, this will be discussed and agreed before proceeding. No additional charges will be incurred without your prior consent.

Our fee arrangements are fixed per service — not billed by the hour. If you have questions about any invoice, please contact us at [email protected].

7. Service-Specific Terms

Consultation: The consultation fee covers one session and a written summary. The consultation does not constitute ongoing legal representation. If you wish to proceed further, a separate engagement is required.

Disputed Claim Representation: Our representation is limited to the specific matter agreed in the engagement letter. Changes in scope require written agreement. We will keep you informed at each meaningful stage and will not take action on your behalf without your approval.

Ongoing Pension Protection: This arrangement includes the services specified in your engagement letter and covers an agreed period. Scheduled reviews will be conducted as set out in your agreement. Matters arising outside the agreed scope may incur separate fees.

The information on our website is provided for general information only and does not constitute legal advice. Engaging our services through a formal Agreement is necessary to receive legal advice.

While we take our work seriously and apply care and skill to every matter, we cannot represent that any particular outcome will be achieved. The result of any pension claim or dispute is subject to decisions by third-party authorities and is not within our control.

9. Limitation of Liability

To the fullest extent permitted by Malaysian law, Bakti Guaman's liability for any claim arising out of the provision of services is limited to the fees paid for the specific matter giving rise to the claim.

We are not liable for any indirect, consequential, or special losses, including loss of income or loss of anticipated savings, unless caused by our gross negligence or wilful default.

Nothing in these Terms limits our liability for fraud, professional negligence, or any liability that cannot be excluded by law.

10. Indemnification

You agree to indemnify and hold harmless Bakti Guaman from any claim, loss, damage, or expense (including reasonable legal costs) arising out of your breach of these Terms or your provision of inaccurate or misleading information in connection with your matter.

11. Termination

Either party may terminate a service engagement upon written notice to the other. Where you terminate an engagement, fees for work completed to that point remain payable. Where Bakti Guaman terminates an engagement, we will provide reasonable notice and will assist in an orderly handover where required.

On termination, clauses relating to fees, intellectual property, limitation of liability, and dispute resolution survive.

12. Dispute Resolution

These Terms are governed by the laws of Malaysia. Any dispute arising under these Terms will first be subject to good-faith discussion between the parties. If unresolved, the matter will be referred to mediation before any court proceedings are commenced.

The parties submit to the exclusive jurisdiction of the courts of Malaysia in respect of any dispute not resolved by mediation.

13. General Provisions

These Terms, together with any written Agreement or engagement letter, constitute the entire agreement between you and Bakti Guaman in relation to the subject matter covered.

If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force. Our failure to enforce any provision at any time does not constitute a waiver of our right to do so in the future.

We may not assign our obligations to you without your consent. You may not assign your rights under any engagement without our written consent.

14. Changes to These Terms

We may update these Terms from time to time. Updated Terms will be posted on our website with a revised date. Continued use of our website or engagement of our services after any update constitutes acceptance of the revised Terms.
